For easier installation, don't cut the zip tie until the gate has been installed.
The gap between the latch and frame is understandable, neither defective nor bended, and would be shortened after installation.
For installation, just place the gate at the doorways, stairs or any openings, then rotate the tension nuts until the space between the handle and latch is within 2mm.
It is suggested to use wall cups if you want to install the gate at the top of stairs for better security.
